Pet Food Express Rewards™ Terms & Conditions

Welcome to the Pack!

Pet Food Express Rewards™ is a customer loyalty program offered by Pet Food Express, LLC ("Pet Food Express" or "Us"). Members earn points on eligible purchases to redeem for future discounts and access exclusive deals, such as Buy 3 Get the 4th Free . No purchase is necessary to join.

To join Pet Food Express Rewards and become a member, you must accept and agree to be bound by these Pet Food Express Rewards Terms & Conditions (“Rewards Terms”), which governs your participation in the loyalty program and relationship with Pet Food Express (“you” or a “Member”). As a condition of enrollment, you must confirm your acceptance of these Rewards Terms, when signing up, either (i) in-store via the pin pad at the cash register, or (ii) online by completing the sign-up flow.

BY ACCEPTING THE PET FOOD EXPRESS REWARDS TERMS, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 18 YEARS OLD AND HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THE TERMS AND TO ABIDE BY ALL OF THE REQUIREMENTS SET FORTH HEREIN. These Rewards Terms are subject to and include and incorporate Pet Food Express’s Website Terms of Use and Privacy Policy , including the section titled “Notice of Financial Incentive.”

ARBITRATION NOTICE: YOUR PET FOOD EXPRESS REWARDS™ MEMBERSHIP IS SUBJECT TO THE ARBITRATION CLAUSE INCLUDED IN SECTION TITLED "DISPUTE RESOLUTION, ARBITRATION" BELOW, WHICH STATES THAT YOU AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION ON AN INDIVIDUAL-BASIS, AND YOU AND PET FOOD EXPRESS WAIVE ANY RIGHT TO PARTICIPATE A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. PLEASE REVIEW THIS SECTION CAREFULLY.

Updates to these Rewards Terms

Pet Food Express may revise these Rewards Terms at any time in our sole discretion with or without notice to you. Unless a specific date is stated, changes will be effective immediately upon posting and the revised version will replace any prior versions in their entirety. THE UPDATED REWARDS TERMS WILL BE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES, REGARDLESS OF WHEN THE DISPUTED INTERACTIONS AROSE. YOUR CONTINUED PARTICIPATION AFTER WE POST CHANGES TO THESE REWARDS TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CLOSE YOUR REWARDS ACCOUNT. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

MEMBERSHIP

1.                   Enrollment Process

No purchase is necessary to join Pet Food Express Rewards. In addition to accepting the Rewards Terms, Customers must also provide a first and last name, email, and unique phone number to complete their enrollment and open their Pet Food Express Rewards ("Rewards ID"), therefore the phone number you provide at sign-up must be unique to each Rewards Account. Rewards Accounts are limited to one individual per account, and Pet Food Express reserves the right to terminate duplicate accounts without transferring points from the duplicate accounts to the remaining account.

Consent to Marketing Emails . As a condition of enrollment, you also agree to receive (i) transactional emails with information about your account, your purchases, and the Pet Food Express Rewards program, as well as (ii) promotional emails from Pet Food Express. You may opt-out of promotional emails at any time. If a member opts out of promotional emails, they will continue to receive transactional emails.

Your membership will continue until you cancel it or until it is terminated by Pet Food Express in accordance with these Rewards Terms or for any other reason in our sole discretion.

2.                   Earning Points

After enrollment, members will earn 1 point for every $1.00 U.S. dollar spent (i) in-store, on purchases of merchandise, pet wash tokens, and gift cards at the time of the transaction, and (ii) online orders on www.petfood.express of merchandise and pet wash tokens when your credit card is charged, after any refunds or substitutions. Points are calculated at checkout on a single-transaction basis for all eligible items, before sales tax, delivery, and/or any other fees or charges and previously earned points will be deducted upon return of any eligible item. Points eligibility may vary when applying other discounts and special offers, depending on the specific terms of the other offer and our transaction system programing. Pet Food Express reserves the right to modify and limit points eligibility and accrual at any time for any reason.

From time to time, we may also offer special promotions where members can earn points at different rates and/or for different actions, subject to the promotion’s specific terms and conditions.

To earn points, eligible purchases must be linked to your Rewards ID in our system when the purchase is made. When shopping in a Pet Food Express store, you must provide your Rewards ID to the sales associate prior to completing the transaction. When shopping online at www.petfood.express , you must be logged into your account prior to completing the transaction. After you complete your Pet Food Express Rewards enrollment, your future AutoDelivery orders will earn points upon fulfilment.

Points will not be earned:

·          Retroactively, for purchases made prior to joining Pet Food Express Rewards;

·          On amounts paid with a Pet Food Express Gift Card or Merchandise Card;

·          On cancelled/chargeback transactions;

·          On in-store purchases if a Member failed to enter their membership number when prompted at check-out;

·          On online orders if a Member failed to log in to their Pet Food Express Rewards Account prior to completing their transaction.

Points cannot be transferred to another member or redeemed for cash. Points have no cash or other monetary value other than the converted Rewards value set by Pet Food Express under these Rewards Terms. No credit or cash will be given for unused points.

3.                   Redeeming Rewards

Accumulated points will be converted to as redeemable “Rewards” at a rate of 100 points = $1.00 Reward.

When shopping in store, members can redeem their available Rewards balance as a discount on eligible purchases of merchandise and Pet Wash Tokens. Points automatically convert to redeemable Rewards in increments of 100.

Discount will be applied at checkout to all eligible items and will be deducted upon return of any item to which the discount was applied. Discount may or may not be combined with other discounts and special offers, depending on the specific terms of the other offer and our transaction system programing. Pet Food Express reserves the right to modify and limit Rewards redemptions at any time for any reason.

At this time, Rewards cannot be redeemed on www.petfood.express online orders. Redemption discount cannot be applied to taxes or other fees, gift card purchases, nor retroactively to past purchases. Rewards cannot be transferred to another member or redeemed for cash. Rewards have no cash or other monetary value other than redeemable value set by Pet Food Express under these Rewards Terms. No credit or cash will be given for unused Rewards.

4.                   Account Management

Members can check their account status and points balance in a few ways, including:

·          In store, by asking an associate.

·          Online, by logging into your account. You must create an account first.

·          By contacting Customer Service.

Pet Food Express Rewards accounts are not transferable and are not for sale, resale or barter. Pet Food Express reserves the right to verify a member’s identity related to a member’s account activity. All account balances are based on Pet Food Express’s internal transaction records.

If you believe there is an error in points calculation or account balance, or notice suspicious activity related to your account, immediately contact Customer Service for assistance by emailing hello@PetFoodExpress.com . Customer Service may adjust or reinstate points in their sole discretion for any reason at any time, including but not limited to verified cases of point theft or fraud.

5.                   Third-Party Marketplaces

At this time, points cannot be earned on purchases made on third-party marketplaces, such as Amazon.com, DoorDash, Instacart, and UberEats.

6.                   Account Inactivity, Point Expiration

Members can review their transaction history and Rewards activity online by logging into their account. Pet Food Express will consider your account inactive if no new transactions or Rewards activity can be linked to the account. If your account remains inactive for 12 consecutive months or more, your account balance will be forfeited and reset to zero. Account balances forfeited for inactivity cannot be recovered.

7.                   Member-Exclusive Offers

From time-to-time, we may offer special discounts, pricing, or members-only promotions to you.

In-Store Only - Buy 3 Get the 4th Free (“B3G4F”). Members can mix and match 4 qualifying items within the same category in a single transaction and get the lowest priced item for free! Discount is automatically applied to groups of 4 qualifying items, reducing each item's price in relative proportion equal to the original price of the lowest priced item. Member is responsible for sales tax on the subtotal. Subject to product availability at time of purchase. Qualifying returns of B3G4F items will be refunded in the amount equal to its discounted purchase price or may be exchanged for items of equal original price.

8.                   Returns & Exchanges

All purchases are subject to our Retail & Return Policy. Please review our full Retail & Return Policy for full detail.

Returns of merchandise will be for the price actually paid after applying any discounts, including but not limited to Rewards redemption discounts, and the previously redeemed Rewards will be reinstated. Rewards will not be reinstated for any exchanges or store credit refunds to Merchandise Card.

MEMBERSHIP TERMINATION

9.                   Member Cancellation

You may cancel your Pet Food Express Rewards membership at any time for any reason by logging into your www.petfood.express account and following the membership cancellation instructions, or email hello@PetFoodExpress.com . When you cancel your membership, you will:

When you close your Rewards Account, you will:

·          immediately forfeit all previously accrued points and redeemable Rewards;

·          no longer accrue new points on Pet Food Express purchases;

·          no longer have access to member-exclusive promotions; and

·          close your Pet Food Express Rewards account; but

·          continue to have access to your non-member www.petfood.express customer account; and

·          continue to be enrolled in marketing communications, unless you have opted out.

10.                   Reopening Closed Account, Balance Reinstatement Conditions

You can reopen a closed Pet Food Express Rewards account by contacting Pet Food Express Customer Service; provided that you have not otherwise been found to have violated these Rewards Terms or any other Pet Food Express policy. Any points and/or Rewards remaining in an account at the time of closure are immediately forfeited and cannot be reinstated, unless your request is made within 30 days of closure.

11.               Pet Food Express Termination

Pet Food Express reserves the right to (i) reject any individuals from enrollment, (ii) suspend, terminate, and/or revoke any memberships, (iii) remove or adjust points and Rewards (iv) modify any content, aspect, or feature of a member’s account and/or (v) cancel orders for any reason in our sole but reasonable discretion, but especially in situations where we become aware of or suspect a Rewards Terms violation, abuse, fraud, misuse or gaming related to earning points and redeeming Rewards, or any other conduct detrimental to the interests of Pet Food Express. If Pet Food Express revokes or otherwise cancels your membership, we will close your account, and any accrued balances of points and/or Rewards will automatically expire.

DISPUTE RESOLUTION, ARBITRATION AGREEMENT

12.               Informal Disputes, Customer Service Inquiries

If a dispute should arise between you and Pet Food Express, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our Customer Service team, reachable by emailing hello@PetFoodExpress.com or by calling 1-888-439-9059.

If your dispute cannot be resolved by working with our Customer Service team, this Section of the Rewards Terms describes how the parties will proceed with the resolution of the dispute.

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND PET FOOD EXPRESS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE REWARDS TERMS OR THE PET FOOD EXPRESS REWARDS CUSTOMER LOYALTY PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

13.               Legal Disputes; Arbitration; Class Action Waiver; Jury Trial Waiver

PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND HAVE A TRIAL IN FRONT OF A JURY.

NO CLASS ACTIONS : EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR SIMILAR PROCEEDING.

WAIVER OF JURY TRIAL : EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS THEY MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTES WHATSOEVER BETWEEN THE PARTIES, INCLUDING BUT NOT LIMITED TO, DISPUTES IN ANY WAY ARISING OUT OF OR RELATING TO THE PET FOOD EXPRESS REWARDS CUSTOMER LOYALTY PROGRAM, THESE REWARDS TERMS, OR THE RELATIONSHIP OF THE PARTIES (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY).

ARBITRATION AGREEMENT : These Rewards Terms shall be governed by and construed in accordance with the laws of the State of California, excluding that body of law relating to conflict of laws. The parties agree that any controversy or claim arising out of or relating to these Rewards Terms, or the breach thereof, will be settled by binding arbitration in accordance with California Code of Civil Procedure Section 1280 et seq., and the then current rules and procedures of the American Arbitration Association (AAA). The arbitration shall be a confidential proceeding, closed to the general public. The arbitration will take place in Contra Costa County, California and be conducted in the English language. The decision rendered by the arbitrator will be binding upon the parties hereto, and any judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The parties consent to the jurisdiction of all federal and state courts in California. Venue will lie exclusively in Contra Costa County, California. For the sake of clarity, nothing in this paragraph shall affect Pet Food Express’ ability to seek from a court injunctive or equitable relief at any time.

If any arbitration or other proceeding is brought to enforce or interpret these Rewards Terms or matters relating to it, the substantially prevailing party, as determined by the arbitrator's award, will be entitled to recover reasonable attorneys' fees and other costs and expenses incurred in such arbitration or proceeding from the other party, in addition to any other relief to which such prevailing party is entitled; provided that in no event will the arbitrator have the authority to award punitive damages.

The failure of Pet Food Express to exercise or enforce any right or provision of these Rewards Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by an authorized representative of Pet Food Express in writing.

ADDITIONAL TERMS

14.               Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Pet Food Express and its owners, and their respective officers, directors, employees, successors, and assigns for and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Rewards Terms including, but not limited to your enrollment, your membership, your account activity, and your purchase or use of Pet Food Express-offered services and products other than as expressly authorized in these Rewards Terms.

15.               Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL PET FOOD EXPRESS AND ITS OWNERS, THEIR OFFICERS, OR DIRECTORS, THEIR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR PET FOOD EXPRESS REWARDS ENROLLMENT AND MEMBERSHIP, YOUR USE, OR INABILITY TO USE, OUR WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON OUR WEBSITE OR CONTENT ON SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

16.               Disclaimer of Warranties

YOUR ENROLLMENT, MEMBERSHIP, AND PARTICIPATION IN PET FOOD EXPRESS REWARDS (THE “PROGRAM”) IS COMPLETELY VOLUNTARY AND IS AT YOUR OWN RISK. PET FOOD EXPRESS REWARDS IS A PROMOTIONAL OFFER PROVIDED TO ENROLLED CUSTOMERS ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER PET FOOD EXPRESS NOR ANY PERSON ASSOCIATED WITH PET FOOD EXPRESS OR THE PROGRAM MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE PROGRAM’S COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY NOR THAT YOUR MEMBERSHIP EXPERIENCE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE PROGRAM’S WEBSITE OR ITS WEBSITE SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE PROGRAM OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PROGRAM WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. TO THE FULLEST EXTENT PROVIDED BY LAW, PET FOOD EXPRESS HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE RELATED TO THE PROGRAM. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

17.               Account Monitoring and Enforcement

We reserve the right to monitor all activity linked to or related to your account in order to enforce these Rewards Terms, including investigating, pursuing legal action, cooperating with legal authorities, or otherwise acting on any information related to the violation of these Rewards Terms or any other Pet Food Express policy, infringement of legal rights, that may threaten safety, or may otherwise create liability. We reserve the right to pursue legal action, including involving law enforcement, for illegal or unauthorized Website use.

18.               Choice of Law/Forum Selection

These Rewards Terms shall be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law rules. You further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in Contra Costa County, California.

19.               Severability

Neither these Rewards Terms nor any right, obligation, or remedy hereunder is assignable, transferable, delegable, or sublicensable by you except with the prior written consent of Pet Food Express, and any attempted assignment, transfer, delegation, or sublicense shall be null and void. Pet Food Express may assign, transfer, or delegate these Rewards Terms or any right or obligation or remedy hereunder in its sole discretion. Any heading, caption, or section title contained in these Rewards Terms is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof. If any provision of these Rewards Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Rewards Terms and shall not affect the validity and enforceability of any remaining provisions. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. This is the entire agreement between you and Pet Food Express relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between you and Pet Food Express with respect to such subject matter. These Rewards Terms may not be changed, waived or modified except by Pet Food Express as provided herein or otherwise by written instrument signed by Pet Food Express.
